Driving disqualifications UK

1. Overview
You can be banned (disqualified) from driving if you either:
  • are convicted of a driving offence
  • get 12 or more penalty points (endorsements) within 3 years
You’ll get a summons in the post that tells you when you must go to court.

How long a driving ban will last

The court will decide how long the disqualification will last, based on how serious they think the offence is.
If you have 12 or more penalty points, you could be banned from driving for:
  • 6 months if you get 12 penalty points or more within 3 years
  • 12 months if you get a 2nd disqualification within 3 years
  • 2 years if you get a 3rd disqualification

Disqualified for 56 days or more

If you’re disqualified for 56 days or more you must apply for a new license before driving again.
You might also have to retake your driving test or take an extended driving test before getting your new license. The court will tell you if you have to do this.

Disqualified for less than 56 days

Your paper driving license or counterpart document will be stamped by the court and given back to you. This is called ‘short period disqualification’.
You won’t need to renew your license. The stamp shows the disqualification period and you can use the same license again when this is over.

2. Check when your disqualification ends
You can find the date your driving ban ends:
  • online if you previously applied for your license over the internet
  • on the reminder form D27 that DVLA sends you 56 days before your disqualification ends
  • on the D811 letter issued 90 days before certain drink-related disqualifications end
  • stamped on your paper license or counterpart document if you’re disqualified for less than 56 days
  • by phoning DVLA customer enquiries (phone the DVA if you’re in Northern Ireland)

3. Apply to reduce your disqualification period

You can ask the court to reduce your disqualification period after you’ve been banned from driving for:
  • 2 years - if the disqualification was for more than 2 but fewer than 4 years
  • half the disqualification period - if it was for between 4 and 10 years
  • 5 years - if the disqualification was for 10 years or more
You must have a good reason for asking for the disqualification to be reduced. For example, if you think the court made a legal mistake or there were reasons you committed the driving offence that the court didn’t take into account.
Write to the court that disqualified you with the date of offence, date of conviction and any other supporting information. The court will tell DVLA if it decides to reduce your disqualification period.
If the court refuses your request you have to wait 3 months before you can ask again.

If your disqualification is shortened

Car or motorbike licenses

Apply for a new license by sending DVLA a completed form D1 ‘Application for a driving license’, available from the DVLA form ordering service or most Post Offices.

Lorry or bus licenses

Apply for a new license by sending DVLA a completed form D2 ‘Application for a lorry/bus license’, available from the DVLA form ordering service.

4. Disqualification outside Great Britain

If you’ve been banned from driving on your Great Britain driving license you’re also banned from driving in Northern Ireland, Ireland and the Isle of Man.
This is called ‘mutual recognition of disqualification’. Disqualified drivers from those areas are also disqualified from driving in Great Britain.

5. Changes to your name and address while disqualified

Tell DVLA if you change your name or address while disqualified.
Write with details of your old and new address, name if changed, your driving license number (if known) and date of birth.

6. Disqualification until 'test pass' or 'extended test pass'

If you’re disqualified until ‘test pass’ or ‘extended test pass’ and want to drive again, you must apply for a new provisional driving license before you take the tests you need.

How to get a new license

1.     DVLA will send you a reminder 56 days before your disqualification ends - use this to apply for a new provisional driving license.
2.     Book and take a theory and practical test (or compulsory basic training (CBT) and motorcycle practical test if you ride a motorcycle). If you’re disqualified until ‘extended test pass’, book an extended practical test (which lasts 70 minutes). The fees are higher for extended tests.
3.     When you’ve passed the practical test, ask the examiner to arrange for your new license to be sent to you - you can legally drive as soon as you’ve passed the practical test.
If you want to drive a large vehicle (category C) or a bus (category D) the local traffic commissioner must agree - DVLA will ask them when you apply for your new full license.

7. Disqualification for drunk-driving

DVLA will make medical enquiries before you can renew your driving license if you’re disqualified for some drink-driving offences.
DVLA will write to you and tell you what to do.

Overview

You must have motor insurance to drive your vehicle on UK roads.
Third party insurance is the legal minimum. This means you’re covered if you have an accident causing damage or injury to any other person, vehicle, animal or property. It doesn’t cover any other costs like repair to your own vehicle.
If you’re in an accident
If you have an accident causing damage or injury you must give the following to anyone with ‘reasonable grounds for requiring them,’ for example an insurance company:
  • your name and address
  • the vehicle registration number
You also need to give the owner’s name and address if the vehicle isn’t yours.
You must report the accident to the police within 24 hours if you don’t give your details at the time of the accident.
You must also report the accident to your insurance company, even if you’re not planning to make a claim.

Accidents with uninsured motorists

You should tell the police if you have an accident with someone who’s not insured.
Your insurance company will also be able to give you more advice.

Compensation for victims of uninsured or hit and run drivers

 

You may be able to claim compensation from the Motor Insurers’ Bureau (MIB) if you’ve been injured or your property has been damaged because of an uninsured or ‘hit and run’ driver.

Driving in the European Union (EU)

All UK vehicle insurance provides the minimum third party cover to drive in other EU countries.

Driving in other countries

Outside the EU, a ‘green card’ proves that your insurance covers the minimum cover in the country you’re driving in. Ask your insurance company if they can issue you with one.

Uninsured vehicles

Rules in England, Wales and Scotland

You must have motor insurance for your vehicle if you use it on roads and in public places.
You do not need to insure your vehicle if it is kept off the road and declared as off the road (SORN). This rule is called ‘continuous insurance enforcement’.
If not, you could:
  • get a fixed penalty of £100
  • have your vehicle wheel-clamped, impounded or destroyed
  • face a court prosecution, with a possible maximum fine of £1,000
It doesn’t matter who is driving the car - if you’re the registered keeper, you could get penalized.
You will also still have to pay for your insurance on top of any fines received.

Motor traders - exceptions

If a vehicle is between registered keepers or registered as ‘in trade’ with the Driver and Vehicle Licensing Agency (DVLA), it is excluded from continuous insurance enforcement.
Vehicles you keep for your own use are not excluded.

Driving without insurance

It’s illegal to drive a vehicle on a road or in a public place without at least 3rd party insurance.
Even if the vehicle itself is insured, if you’re not correctly insured to drive it you could get penalized.

Penalties for uninsured drivers:

The police could give you a fixed penalty of £300 and 6 penalty points if you’re caught driving a vehicle you’re not insured to drive.
If the case goes to court you could get:
  • a maximum fine of £5,000
  • disqualified from driving

The police also have the power to seize, and in some cases, destroy the vehicle that’s being driven uninsured.

Motor insurance for visiting and imported vehicles

All drivers using roads in the United Kingdom (UK) must have third party insurance cover.

Drivers entering the European Union (EU) from a non-member state

Under the Motor Insurance Directives, a driver entering the European Union (EU) from a non-member state, (apart from vehicles from Andorra, Croatia, Iceland, Norway and Switzerland), must be able to produce evidence of having the necessary insurance cover for example a Green Card. Routine border checks are not normally carried out as the insurance requirement is checked at the point of entry into the EU.

Vehicles temporarily used in the UK

Vehicles registered in other countries that are temporarily brought into the UK by overseas residents are usually exempt from UK registration and licensing. EU vehicles that are being used within or between Community Member States are allowed, under EC Directive 83/182, to be used on public roads without the need to register or pay duties in the host country.
These provisions limit visits to six months in a 12 month period and the vehicle must comply with the registration and licensing requirements of its home country. To qualify for the exemption, the visitor must have their normal residence outside the host-state.
Residency is normally taken to mean the place where a person usually lives for at least 185 days in each calendar year because of personal and occupational ties.

Enforcement

Enforcement is a matter for the police who can at any time ask a person to demonstrate that they are eligible to use the vehicle without registering and licensing it in the UK. Any vehicle used in this country for more than six months in any 12 has to be registered and licensed here in the normal way with the Driver and Vehicle Licensing Agency (DVLA).

In addition, where the keeper of the vehicle becomes resident in this country, the vehicle must immediately be registered and licensed here. Once a vehicle has been registered in this country, its use must be covered by a motor insurance policy issued by a motor insurer authorized in the UK.

You have to have motor insurance before you can drive your vehicle in a public place.

Why motor insurance is required

Motor insurance protects you, your vehicle and other motorists against liability in the event of any accident. It provides financial compensation to cover any injuries caused to people or their property.

Types of insurance cover

Third party only

This cover is the legal requirement. This level of cover ensures that compensation is available in respect of injury to other people (including your passengers) or damage to other peoples' property resulting from an accident caused by you. It doesn't cover any costs incurred by you as the result of an accident.
Most insurance companies offer additional levels of insurance cover that go beyond the legal requirement. The precise nature of cover will vary from company to company.

Third party fire and theft

This provides the same cover as third party only and also insures you should your vehicle be damaged by fire or stolen.

Comprehensive

This provides the same cover as third party fire and theft. However, it also covers you should your vehicle be damaged in an accident. Many additions to this level of cover are available from insurance companies including:
  • providing a courtesy car while your car is being repaired, legal expenses, insurance to recover your uninsured losses (such as your excess)
  • roadside recovery schemes
  • vehicle repairs in case of breakdown

If you're involved in an accident

If you have an accident that causes damage or injury to any other person, vehicle, animal or property, you must give both your own and the vehicle owner's name and address, along with the registration number of the vehicle, to anyone having reasonable grounds for requiring them.
If you don't give your details then you should report the accident to the police as soon as possible within 24 hours. You must also report the accident to your insurer, even if you're not intending to make a claim.

If you're involved in an accident with an uninsured motorist

Any accident with an uninsured driver should be reported to the police. You should also report any accident to your insurer, who'll advise you further as regards to any claim. Additionally, the Motor Insurers' Bureau (MIB) ensures that compensation is available to the innocent victims of uninsured drivers or hit and run (untraced) drivers.  

United Kingdom (UK) motor insurance and driving overseas

All UK policies provide the minimum cover required by law in other European Union (EU) countries or the minimum cover required by UK law if that is greater. This cover doesn't automatically include theft or damage to your car.
Most people want the same protection they have in the UK when travelling abroad, for example comprehensive or third party, fire and theft. This could, in addition to the legal minimum of third party liability cover, include accidental damage to, or theft of or from, your own vehicle depending on the policy cover.
A number of insurers automatically provide this extended cover for a specified period and often without additional charge. It's important, however, that you check with your insurer or insurance adviser before you go abroad.

The Green Card system and driving overseas

Outside of the EU, a Green Card provides proof that your domestic motor insurance policy covers the minimum legal requirements in the country being visited.

The Green Card system

The Green Card system is designed to make it easier for vehicles to move freely over borders and to protect the interests of the victims of foreign registered vehicles.

The Green Card

The Green Card is a document that is recognized in over 40 countries including all the countries of Europe.
It offers no insurance cover. It is proof that the minimum legal requirements for third party liability insurance in any country for which the Green Card is valid are covered by the insured person's own motor policy.
It’s overseen by the Economic Commission for Europe based in Geneva.

Where the Green Card is needed

A Green Card is not required by law to cross borders within the European Union and some other countries. This is because all EU countries and certain other countries comply with the first directive on motor insurance, which says that every insurance policy issued in the EU must provide the minimum insurance cover required by law in any other EU country.
The countries that don't need a Green Card are:
Andorra, Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Romania, Slovak Republic, Slovenia, Spain, Sweden and Switzerland.
The countries that do need a Green Card are: Albania, Belarus, Bosnia and Herzegovina, Former Yugoslav Republic of Macedonia (FYROM), Islamic Republic of Iran, Israel, Moldava, Morocco, Russia, Serbia and Montenegro, Tunisia, Turkey and Ukraine.

Where to get a Green Card

Many insurers will issue a Green Card, but have no obligation to do so. If they won't, you may wish to make enquiries with other insurers or ask about getting border insurance at the point of entry into the country.
The Green Card document itself is only proof that the minimum third party liability cover required by law in the visited country is in force. You should check with your insurer to make sure that your UK policy cover is fully in force when you travel abroad whether or not a Green Card is issued.
Within the countries where frontier inspection is no longer required, the Green Card is still the insurance document most readily recognised and understood by national police forces. As you may need to produce evidence of insurance other than at a border for example after an accident, you may consider it advisable to carry a Green Card to avoid any inconvenience.
